Terms & Conditions
Deposits & payments:
- To reserve your place on one of our tours, please contact us to check the availability of your preferred tour. To secure a booking we require a completed booking form together with a non-refundable deposit as indicated on each tour
- The remaining balance is required by the date indicated on each tour option. All prices are quoted in New Zealand dollars and prices quoted are per person based on twin share accommodation.
- Any reservations made within 30 days of the tour departure must be paid in full.
- Single supplement – additional charges apply and is subject to availability
- Any customer who has booked a tour shall not assign, purport to assign, or attempt to re-sell the package (whether whole or in part), rights or interests under these Terms without prior written consent from Unique Holiday Tours.
Cancellation Fees:
In the event of passengers canceling their booking, the following cancellation fees will apply on a per person basis (not per booking).
- Cancellation 65 days or more prior to departure the non-refundable deposit is transferable to another tour with in the same season and the following season only.
- Cancellations between 45 and 30 days prior to tour departure: 25% of holiday price plus any applicable supplier cancellation fees.
- No refunds after 30 days prior to departure and no refunds will be given on any unused portion of the tour.
Itinerary Variations :
Tour itineraries are correct at the time of printing but are subject to change without notice. The tour itinerary could change due to road or weather conditions, changes imposed by other tour operators, or a range of other factors outside our control. Unique Holiday Tours holds no liability in the unfortunate event there are changes outside of our control.
Force Majeure:
Unique Holiday Tours accept no liability and will not pay any compensation where the performance of our contractual obligations is prevented or affected by circumstances amounting to “force majeure”. In these terms, ‘force majeure’ means any event that has an impact on a Packaged Tour which we or the other operator (where relevant) could not, even with all due care, foresee or avoid. Such events may include war or threat of war, riots, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, pilferage, epidemics, pandemics, forced quarantine, medical or customs regulations, riot, fire, storm, flood, explosion, compliance with any law or government restraint order, rule regulation, strikes, lockouts, or any other cause not reasonably within the control of our control. Unique Holiday Tours reserve the right to cancel, amend or reschedule the Packaged Tour during or following any force majeure and will have no liability for any direct or indirect consequences of the cancellation, amendment, or rescheduling.
Customs, Immigration, And New Zealand Law:
It is the passenger’s responsibility to comply with any New Zealand immigration, customs, and/or quarantine regulations when entering New Zealand and to comply with New Zealand laws when in the country. Unique Holiday Tours will not, under any circumstances, have any liability or responsibility where passengers do not comply with any customs and immigration rules and regulations or fail to comply with any laws during the tour.
Tour Cancellations:
Unique Holiday Tours reserves the right to cancel or withdraw any tour or any booking made for a traveller. In this event, we will refund the total tour price, but will not have any further liability to the traveller.
Liability:
Unique Holiday Tours Ltd is not liable for personal injury or property damage arising from participating in any of its tour activities. The arrangement providers, namely the carriers providing land, sea, or air travel, the operators providing transfers, accommodation, tours, meals, and other services, all do so according to their conditions. The traveller accepts the arrangements subject to those conditions and accepts that their rights may be limited to those conditions as found in tickets, vouchers, signs, forms, contracts, and the like. The traveller has no right to claim against Unique Holiday Tours for any loss, damage, delay, or injury caused to the traveller or their baggage whilst under the care or control of an arrangement provider. A traveller’s baggage and personal effects shall be carried at the owner’s risk as provided for under the Carriage of Goods Act. Unique Holiday Tours Ltd is not responsible for any losses or additional expenses due to delays or alterations in air, land or sea travel due to inclement weather, acts of God, strikes, breakdowns, civil unrest, quarantine, or other circumstances beyond its control.
Brochure Pricing:
The prices that appear in the brochure are valid at the time of publication. The Company reserves the right to change pricing at any time after publication should this be forced upon us. Should changes occur you will be notified.
Photographs:
Unique Holiday Tours may include some photographs and/or videos taken by our employees that will be used for future promotional advertising purposes and by booking on to our tours you authorise the use of any images you are captured in to be used for this purpose without any further consent or payment.
Acknowledgment and Acceptance:
In booking a tour with Unique Holiday Tours the participant(s) acknowledge that they have read, understood, and accept these conditions.
COVID19 Cancellation / Refund Policy:
Covid19 has created uncertainty for us all, therefore for cancellations directly related to Covid19, we have negotiated special terms which would override ‘normal cancellation’ terms as outlined above;
If the New Zealand Government imposes travel restrictions that would impact the ability to deliver the travel package prior to commencing travel, passengers will receive full credit, less any applicable cancellation fees. If travel restrictions are imposed while on tour, we will seek credits on any unused portions of the itinerary from all suppliers. Any applicable credits will first be applied to any additional costs that Unique Holiday Tours may have incurred on the passenger’s behalf e.g. if alternative accommodation or transportation to repatriate back to the home city or nearest airport etc is required.
If a passenger has been tested positive for Covid19 directly prior to travel or while on holiday with Unique Holiday Tours, with supporting documentation provided (a positive Covid19 test), Unique Holiday Tours will seek credits on any unused portions of the itinerary from all suppliers. Any applicable credits will first be applied to any additional costs that Unique Holiday Tours may have incurred on the passenger’s behalf e.g. if alternative accommodation or transportation to repatriate the passenger to home cities or the nearest airport etc is required. Any remaining refunds will be credited to the passenger.
